SUBSCRIPTION TO BAOSEM NEWSLETTER
ARTICLE 1 : DEFINITION
The present general conditions govern all commercial transactions concluded between the Company BAOSEM "Provider" and any legal or physical person, public or private, national or international "Client" through the platform www.Baosem.com "the Site").
These general terms and conditions of sale "Electronic Contract" are brought to the attention of the Client before the conclusion of any order, they are explicitly listed on the Provider's website. They become legally binding between the Provider and the Customer by the mere placing of an order. The contract shall only be deemed to be complete upon acceptance by the Provider in accordance with the terms and conditions set forth below.
ARTICLE 2: ACCESS TO SERVICES
The services offered by the Provider are accessible via its Web platform 24 hours a day and 7 days a week, except in cases of force majeure, independent events or maintenance interventions necessary for the proper functioning of the service. The Provider undertakes to implement all the means at its disposal to ensure a good quality of access to the service and to ensure the reliability and speed of its products online.
ARTICLE 3: APPROVAL OF THE GENERAL CONDITIONS
The Client acknowledges explicitly and unreservedly accepting the present General Terms of Sale and having read all the terms of the transaction below. When creating an Account, checking the box "Read and Approved" means acceptance.
These Terms and Conditions may be modified by the Service Provider at any time and without prior notice even after the conclusion of the commercial transaction.
ARTICLE 4: PLACING AN ORDER
4.1 subscription steps:
- Log on to the website www.baosem.com.
- Choose the type of subscription Internet and/or print and/or archives;
- Fill in the form by filling in all the fields. The Client guarantees that the information provided to the Service Provider regarding his/her identity and contact details is accurate, truthful and complete;
- Attach the necessary documents to subscribe to the Baosem newsletter (see point);
- Choose the communication medium: Mailing and / or Smsing;
- Choose the sectors to be monitored (maximum 3 sectors) for receiving notifications of publication of tenders related to the Client's sector of activity;
- Approve the terms and conditions by checking the "Read and Approved" box.
- Click on "validate the request".
4.2 File to Provide:
Public clients in the Energy & Mining sector:
National or foreign clients:
- Subscription form filled in;
- Copy of Trade Register- Tax Identification Card- craftsman card ... etc.;
- Proof of payment.
Foreign" client temporarily installed in Algeria:
- Subscription form filled in
- Copy of valid contract.
Non-trading physical clients:
- Completed subscription form;
- Copy of national identity Card.
4.3 Subscription Confirmation:
After the Client has paid the subscription fee displayed on the subscription form, a notification of acceptance of the application and an email confirming receipt of the subscription application will be sent automatically after receipt of the form. The order confirmation will be considered as a signature and acceptance of the operation to be performed. A summary of the order information and these General Conditions will be communicated in PDF format via the order confirmation e-mail address.
4.4 Order Cancellation
In the case of an Internet subscription, the cancellation of the order must be done before receiving the access codes.
In the case of a print subscription, the order is irreversible.
Switching from the internet to the printed version or from the printed version to the internet is not possible before the expiration of the current subscription version.
Subscription Account Creation:
As soon as the commercial transaction is formalized and a subscription account is created, a "single-session" access code consisting of:
- Current and/or archived Internet version subscription:
- A user name;
- A password.
- Printed version subscription:
Subscribers to the print version will receive the Baosem newsletter through a distributor at the delivery address indicated on the subscription form.
ARTICLE 5 : PRICES
The prices of the services are displayed "in fixed and non-revisable prices" beforehand by the Provider before any order is placed and accepted on the website during the validity of the contract, the prices displayed include all duties, taxes and fees applied under the legislative and regulatory provisions on the subject.
ARTICLE 6 : GUARANTEES
Taking into account the various technical constraints related to the use of the Website, in particular, the malfunctioning caused by a break in service, external intrusion, presence of computer viruses or other, the Service Provider undertakes to guarantee the dissemination of information related to the publication of calls for tenders by transmitting the Baosem Bulletin that has not been published on the platform in PDF format "in case of a subscription to the Internet version".
In case of non-printing and non-delivery of the Baosem Bulletin "printed version", the Provider will ensure the distribution of the Bulletin and its transmission in PDF format
ARTICLE 7 : INTELLECTUAL PROPERTY
All the elements of the website www.baosem.com are and always remain the exclusive intellectual property of the Provider. No one is authorized to re-edit, exploit, rediffuse, or use at some title, even partially, whether the site’s elements that would be software, visual or audible…etc. Any simple or hypertext link is strictly forbidden without a written consent of the Provider.
ARTICLE 8: DONNEES PERSONNELLES
The company SARL BAOSEM reserves the right to collect nominative information and personal and/or professional data concerning its Clients. This information is necessary for the orders’ management, as well as for the improvement of the services and information addressed to the Client. it can also be transmitted to the companies which contribute to these relations, such as the competent authorities (legal, administrative or other kind of authorities).
These information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
The Client has the right to access, rectify and object to the personal information and data concerning him/ her, directly on the Provider’s website.
ARTICLE 9 : FORCE MAJEURE
No one can be held responsible for any consequence of an event occurring in the context of force majeure, within the meaning of the article of the Civil Code, and the respect of its jurisprudential interpretation by the Algerian courts. The party intending to rely on force majeure shall notify the other party in writing without delay of any event of which it would be aware, likely to affect the performance of the contract.
ARTICLE 10: THE CONTRACT DURATION
The duration of the contract is 06 months or 12 months "for the current subscription internet and printed version" and 03 months for archive subscription from the day of activation.
The client is informed 30 days before the expiration of his subscription.
